What is DWI?

DWI means Driving While Intoxicated. While it is not yet illegal to drink and then drive in Texas, it is illegal to drink to the point of intoxication and then operate a motor vehicle in a public place. DUI means Driving under the Influence and only applies if you are under 21 years of age.

The State has 3 methods of proving your guilt on a DWI, DUI, or other intoxication offense.  These are:

  • That you did not have the normal use of your mental faculties;
  • That you did not have the normal use of your physical faculties;
  • That you had an alcohol concentration of .08 or higher at the time of driving
